Following the approval of the German Federal Financial Supervisory Authority (BaFin) for PAVIS to provide a payment service, all payments ordered from PAVIS Payments are made in accordance with the extensive requirements of the European Payment Service Directive II, PSD II 2015/2366, for the regulation of payment services and payment service providers in the European single market. This directive resulted in the amendment of the Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz, ZAG) in Germany and came into force on 13 January 2018. PAVIS Payments ensures that all payments are handled at all times compliant with statutory requirements and in accordance with the highest security standards.
Of course, PAVIS Payments also offers its compliant payment service to clients of other IP service providers.
In January 2020, PAVIS Payments GmbH became a service provider in the field of intellectual property management to be granted an official license from the Federal Financial Supervisory Authority (Bundesanstalt für Finanzdienstleistungsaufsicht, BaFin) to provide a payment service. This approval is necessary to make any payment transactions between PAVIS Payments GmbH’s clients and the respective patent and trademark offices around the world fully compliant with statutory requirements.
Compliance requirements are regulated by the Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz, ZAG), which has been in force since 31 October 2009 and is based on the first EU Payment Services Directive of 2007. On 13 January 2018, the new EU Payment Services Directive, PSD II, was implemented into national law in Germany.
PSD II is the directive for the regulation of payment services and payment service providers in the European single market and is being implemented by all EU states over time. The heightened security measures for European payment transfers are to prevent financial crime, money laundering and financing of terrorism. Furthermore, PSD II is intended to strengthen consumer protection, promote innovation and increase competition in the market by removing obstacles to the cross-border provision of payment services.
As a licensed payment provider we protect our customers and make payment transactions more secure - not only in the single European market, but also worldwide. PAVIS Payments customers also benefit from clearly structured and fully transparent processes.
Previously, PAVIS GmbH has made payments in the name and on behalf of third parties to renew patents and trademarks worldwide. In order to provide payment services in compliance with statutory requirements as per the new EU Payment Services Directive PSD II, PAVIS Payments GmbH was established in 2018 for handling all future regulated payment services in the field of IP.
Since 1 July 2020, PAVIS GmbH has transferred regulated payment services with all associated rights and obligations to PAVIS Payments GmbH.
In a free initial consultation, we discuss all relevant details such as size of portfolio, current use of IP software, current handling of payments. Based on the information gathered, we prepare a detailed proposal tailored to our clients’ exact requirements.
Following transfer of client data, we conduct plausibility checks, send test reports and discuss the results. Our PAVIS experts give assistance and advice regarding any data correction and cleaning which may be required. After an order has been placed for payment of annuities or renewal fees, PAVIS as an intermediary instructs PAVIS Payments to handle the payment on behalf of the client.
At that point, PAVIS Payments reliably takes care of timely worldwide payments. The processing of the payments is subject to the highest security and quality standards in accordance with the strict requirements for compliance with the relevant EU directives. Official or unofficial confirmations such as certificates, payment notes or order confirmations are then forwarded to the client by PAVIS.
Any confirmations and documents are forwarded to the client for checking and safe-keeping by PAVIS, as per our usual practice.
